By using Rift, you agree to these Terms of Service. Please read them carefully. If you do not agree, you may not use Rift.
Rift is a communication platform operated by ModemINC ("ModemINC", "we", "us", "our") that lets people create communities, chat, share media, hold voice and video calls, and connect in real time. These Terms of Service (the "Terms") are a binding agreement between you and ModemINC and govern your access to and use of the Rift platform - including our websites at modeminc.com/rift, the Rift desktop and mobile applications, the Rift API, bots, and all related services (together, the "Service").
These Terms incorporate our Privacy Policy and our Community Guidelines. If there is a conflict between those documents and these Terms, these Terms control.
You must be at least 14 years of age, and meet the minimum digital-consent age of your country if it is higher, to create an account or use Rift. By registering, you confirm that you meet this requirement. If we discover that a user is under 14, we will terminate their account.
Users under 18 must have permission from a parent or guardian, and should review these Terms together with them.
We are building Parent Accounts - supervised account linking that lets a parent or guardian control what a minor can access (for example, which servers they may join and which features are available). Until that ships, supervision is manual: parents and guardians are responsible for supervising minors in their care.
No content moderation is perfect. Despite automated systems and human review, users may encounter content that is upsetting or inappropriate. If you are not comfortable supervising a minor's use of an online chat platform, do not allow the minor to use Rift.
By signing up, you acknowledge and agree that: you use Rift at your own risk; ModemINC does not pre-screen User Content and is not responsible or liable for content posted by users or for interactions between users; and while we act on reports and try to help, we cannot guarantee any particular outcome.
You are responsible for maintaining the security of your account credentials. Do not share your password. You are responsible for all activity that occurs under your account, whether or not you authorized it. Use a strong, unique password and enable two-factor authentication where available. You may not sell, transfer, rent, or share your account, and you may not create accounts by automated means. We may reclaim usernames that are inactive, infringe trademarks, or impersonate others.
Subject to these Terms, ModemINC grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service and to install the Rift applications on devices you own or control. This license exists only to let you use Rift as intended. You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of any part of the Service, except where a license accompanying a component expressly permits it or the law forbids that restriction.
You agree not to use Rift to:
The Community Guidelines contain further detail. Servers that violate these rules will be removed. Repeat offenders will be permanently banned, including by device and network identifiers where lawful.
By default, all servers on Rift are private and invite-only. To make your server publicly listed, you must submit it for review. Every public server on Rift is human reviewed before it is listed. We may reject or remove any server from the public directory at any time, for any reason.
You retain ownership of Your Content. To operate the Service, you grant ModemINC a worldwide, non-exclusive, royalty-free, sublicensable (to our infrastructure providers) license to host, store, reproduce, adapt (for technical purposes such as transcoding and thumbnails), display, and distribute Your Content, solely as needed to provide, maintain, and improve the Service. This license ends when Your Content is deleted from the Service, except for copies kept in routine backups for a limited period or where retention is legally required.
You are solely responsible for Your Content and must have all necessary rights to post it. We may remove or restrict any Content at our discretion, with or without notice, if we believe it violates these Terms, the Community Guidelines, or the law.
We respect intellectual property rights. If you believe content on Rift infringes your copyright, email Gav2011@modeminc.com with: (a) identification of the work, (b) the location (link or server/channel) of the allegedly infringing material, (c) your contact information, (d) a statement of good-faith belief that the use is unauthorized, and (e) a statement, under penalty of perjury, that the information is accurate and you are the rights holder or authorized to act for them. We will remove infringing material and terminate repeat infringers' accounts.
Rift provides APIs, webhooks, and bot accounts for developers. If you build on them, you additionally agree to:
API access may be limited, changed, or revoked at any time. Local integrations exposed by the Rift desktop app can be disabled by the user in Settings.
Rift offers paid subscription tiers - Quantum and Core - currently billed via Ko-fi. Subscriptions are billed monthly and you may cancel at any time; access continues to the end of the paid period. Except where required by law, payments are non-refundable and no refunds or credits are issued for partial periods, downgrades, or unused features. Initiating a chargeback instead of contacting us may result in suspension of Premium features while the dispute is reviewed.
We may change subscription pricing or features with 30 days notice, communicated in the app or by email. Perks are cosmetic or convenience features and may evolve over time.
We aim to keep Rift available and reliable, but we do not guarantee uptime, and the Service may change, be interrupted, or be discontinued (in whole or in part) at any time. We may add, modify, or remove features, apply usage limits, or restrict access for maintenance and safety. Current status is published at modeminc.com/rift/status. We are not liable for outages, data loss, or disruptions.
We may offer alpha, beta, preview, or experimental features. These are provided as-is, may be unstable, may change or vanish without notice, and may be subject to additional terms presented at enrollment.
The Service may contain links to, embeds of, or integrations with third-party websites and services (for example, embedded videos, payment processors, or connected accounts). ModemINC does not control and is not responsible for third-party services, their content, or their privacy practices. Your use of them is at your own risk and subject to their terms.
We may suspend or terminate your account, or restrict any feature, at any time if we reasonably believe you have violated these Terms, created risk or legal exposure for us or other users, or where required by law. Where appropriate we will state the reason. You may delete your account at any time from account settings.
Upon termination: your license to use the Service ends; we may delete Your Content after a reasonable period; and sections of these Terms that by their nature should survive (including 9-11 and 17-21) survive.
Rift is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, uptime, or security. We do not warrant that Rift will be uninterrupted, error-free, or free from loss, corruption, attack, viruses, interference, hacking, or other security intrusion. You use Rift at your own risk.
We use reasonable, industry-standard measures to protect your data (see our Privacy Policy). However, no method of transmission or electronic storage is 100% secure, and we cannot guarantee absolute security. To the maximum extent permitted by law, ModemINC is not liable for any unauthorized access to, disclosure of, alteration of, or loss of your data, including any data breach or security incident, whether caused by third parties, infrastructure providers, or otherwise. Where a breach occurs, we will notify affected users and authorities as required by applicable law. You are responsible for using a strong, unique password and for not sharing content or personal information you are not comfortable being exposed in the event of a breach.
To the maximum extent permitted by law, ModemINC, its owners, and its operators shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of data, profits, goodwill, or other intangible losses, arising from or related to your use of (or inability to use) Rift - including any User Content, conduct of any user, data breach, security incident, outage, or loss of content - even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claim shall not exceed the greater of (a) the amount you paid us in the 12 months prior to the claim, or (b) 50 USD. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; in that case liability is limited to the smallest extent permitted by law.
You agree to indemnify and hold harmless ModemINC and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of Rift, Your Content, or your violation of these Terms, any law, or the rights of a third party.
These Terms are governed by the laws of the jurisdiction in which ModemINC operates, without regard to conflict-of-law rules. Before filing any claim, you agree to first contact us and attempt to resolve the dispute informally for at least 30 days. If it cannot be resolved informally, you agree that disputes will be handled on an individual basis, and you waive any right to participate in a class action, to the extent permitted by law. Nothing in this section prevents either party from seeking injunctive relief or using small-claims court where eligible.
You may not use the Service if you are located in a country embargoed by, or are on a restricted-party list of, the jurisdictions in which we operate, and you agree to comply with applicable export-control laws.
If you send us ideas, suggestions, or feedback, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or compensation. Don't send feedback you consider confidential.
We may update these Terms periodically. Material changes will be communicated via a platform announcement (and by email where appropriate) at least 7 days before they take effect, except changes required for legal or safety reasons which may take effect immediately. Continued use of Rift after changes take effect constitutes acceptance. If you do not agree to a change, stop using the Service and delete your account before it takes effect.
